[1] The key phrase in these documents which is on page 3. " The Grantee in accepting this easement, agrees for itself, its successors and assigns, to pay for the cost of repairing, resurfacing and maintaining the Access Road after it has been constructed by the Grantee, forever and assumes any and all liability which is incurred, or results from the construction, maintenance, and use of the Access Road by anyone in connection with the Access Road, and agrees further to hod harmless the Grantors, their heirs, executors, administrators, personal representatives, successor and assigns for the same forever. " This page has two other subsections that basically state that it is the responsibility of the Homeowner's to maintain the Access Road and the "Grantors have no obligation to contribute to said homeowners fund."The GRANTORS are the original builders of WPCAThe GRANTEES are the homeowners and the HOA.
